1. These Terms and Conditions of Sale and Purchase (hereinafter referred to as the “Terms and Conditions”) are a legally binding document which sets out the rights, obligations and responsibilities between the Buyer (hereinafter referred to as “You”) and the Seller DMO Music Group (hereinafter referred to as “We”) in relation to the purchase of goods for You in the electronic shop www.donnymontell.com (hereinafter referred to as the “e-Shop”).

2.1 The contract between You and Us shall be deemed to have been formed and shall commence from the moment You click on the “Order” button in the e-shop, after having created a shopping basket, indicated the delivery address, selected the payment method and read Our Terms and Conditions and shall remain in force until the order has been paid for and the goods have been fully delivered to Us.
2.3 Every contract concluded between Us and You is stored in the e-shop.
2.4 An order sent or printed by email constitutes a contract of sale with the e-shop, for which payment is made.

3.1 You have the right to purchase goods from the e-shop in accordance with these terms and conditions and the e-shop.
3.2 You have the right to withdraw from the contract for the sale of goods with the e-shop, unless the contract is concluded for:
3.2.1 participation in games or lotteries;
3.2.2 in other cases where the contract of sale and purchase cannot be withdrawn, in accordance with the laws of the Republic of Lithuania.

4.1 You must pay for the goods within 3 (three) working days of the order being placed and accept the goods unless otherwise agreed.
4.2 If there is any change in the details you provided at the time of purchase, you must notify us immediately by email to info@www.donnymontell.com
4.3 If you refuse to accept the goods at the time of delivery without good reason, you shall be liable for the cost of returning the goods.
4.4 By using the e-shop, you agree to these terms and conditions of sale and must comply with them.

5.1 If the Buyer attempts to interfere with the operation or stable functioning of the e-shop, we may, without prior notice, restrict, suspend or terminate the Buyer’s access to the e-shop.
5.2 We may, in important circumstances, temporarily or permanently suspend the operation of the e-shop without prior notice to you.
5.3 We may unilaterally change the terms and conditions of these Terms and Conditions.

6.1 To provide you with all the conditions for the proper use of the services provided by the e-shop.
6.2 Deliver the goods you have ordered to the address you have specified and within the agreed delivery period.
6.3 In the event of important circumstances where we are unable to deliver the goods you have ordered, we undertake to offer you an equivalent product and, in the event that you refuse to accept an equivalent product, to refund your payment within 14 (fourteen) working days.

7.1 The Goods shall be delivered by Us or Our authorised representative.
7.2 At the time of delivery of the Goods, You must inspect the condition of the Goods with Us or Our authorised representative.
7.3 Once You have signed the Invoice or the delivery document, the Consignment shall be deemed to have been delivered.
7.4 If You notice any damage to the Consignment, You have the right not to accept the Consignment, in which case the Consignment will be returned to Us.

8.1 The Buyer may return unsuitable goods within 14 days of receipt of the goods.
8.2 The returned item must be fully complete. The Buyer is responsible for the complete assembly and packaging of the item. If the item is not complete and properly packed, We or Our representative will not accept the item for return.
8.3 The Item must be returned in the packaging in which it was delivered. The packaging must be undamaged, clean, properly prepared and packed.
8.4 You must return the goods at your own expense, unless the return is due to the quality of the goods.
8.5 Where Goods are returned which are not of good quality, We undertake to collect the faulty Goods and replace them with similar Goods. In the event that We do not have an equivalent item, We will refund the money paid by You for the item.

9.1 You are solely responsible for the accuracy of the details provided on the registration form. If You do not provide accurate details on the registration form, We shall not be liable for any consequences arising therefrom.
9.2 You are responsible for the actions you take when using the e-shop.
9.4 We are not responsible for the information provided on the websites of other companies, even if You access these websites via links on Our e-shop.

10.1 We will send all communications to the email address or telephone number provided on your order form.
10.2 You shall send all notices and enquiries by the means specified in the “Contact Us” section of Our e-shop.

11.1 Any information which relates to personal data is subject to the Seller’s personal data protection policy, which is governed by the relevant Laws of the Republic of Lithuania and is enforced in accordance with the recommendations of the State Data Protection Inspectorate.
11.2 The retention period of the Buyer’s personal data shall be 5 years from the Buyer’s last purchase in the Shop.
11.3 The Seller shall not transfer (except in accordance with the procedure established by the Laws of the Republic of Lithuania) the Buyer’s personal data to third parties, except for persons contributing to the execution of the order, for whom the data is necessary for the successful execution of the order (e.g. postal couriers).
11.4 The collection, processing, storage and use of personal data is defined in the Privacy Policy of www.donnymontell.com, which is an integral part of the Bloodo.es e-shop rules.

12.1 The distribution of any e-shop information (text, files, photos, images) without the written consent of the Seller is prohibited.
12.2 These Terms and Conditions are governed by the law of the Republic of Lithuania.
12.3 All disagreements arising from the execution of these rules shall be settled by negotiation. In the event of failure to reach an agreement, disagreements shall be settled in accordance with the procedure established by the laws of the Republic of Lithuania.
